Any reservation or purchase of a product from the services of CHEMS AYOUR automatically implies adherence to these terms and conditions of sale.
Customers and/or users of this site are invited to read carefully these conditions before each reservation.
Presentation of the offer and rates
The description of CHEMS AYOUR’s products offered on the site are likely to be modified or to evolve during the year.
The prices are indicated in Moroccan Dirhams, all taxes included, and include the dinner as provided in the menu and the show.
CHEMS AYOUR reserves the right to modify its rates at any time, the Service being however invoiced on the basis of the rates in force at the time of the order registration.
Promotional offers, subject to specific terms and conditions, may be proposed by CHEMS AYOUR.
Reservation conditions
The reservation is made with the agents of the company CHEMS AYOUR by internet site.
A refund can be claimed in case of cancellation of the Dinner Show reservation, but no refund can be claimed in case of modification by CHEMS AYOUR of the show program, the menus and/or the drinks.
Terms of payment
The payment can be made online, by credit card, by check, bank transfer, subject to sufficient time to ensure its proper collection. In this case, the reservation request will only be confirmed upon receipt and effective collection of the payment. The bank cards accepted on the Site are those of the CARTE BLEUE/VISA, EUROCARD/MASTERCARD networks.
In case of payment by check, it should be made out to CHEMS AYOUR and sent to its attention, Temsia, Agadir (5 min from Al Massira airport)
The customer must indicate on the back of the check the number of his file which will have been given to him by telephone by the reservation agent.
Confirmation of the order
Once the payment for the Service has been received, CHEMS AYOUR will send the Customer an order confirmation by e-mail, or by mail, subject to sufficient time, and the shipment of the ticket.
Each ticket allows a unique access, for a single Customer, to the CHEMS AYOUR complex for the single Service for which it was issued. Only the first presentation of the ticket will give access to the room of the CHEMS AYOUR complex.
Any subsequent presentation of the same ticket or a copy will be automatically refused. The customer must present this document in order to be able to benefit from the services concerned. In case of loss or forgetfulness of this document, CHEMS AYOUR will be entitled to ask for the full payment of the service on the spot, without any obligation to reimburse the customer for the amounts paid.
The resale of tickets is forbidden. Any reproduction of the ticket, whether electronic or not, is forbidden in any form whatsoever.
Cancellation and modification conditions
Tickets for shows and services are not subject to a right of withdrawal. Nevertheless, reservations made by CHEMS AYOUR can be, with its agreement, cancelled or modified, at the customer’s request up to 72 hours before the performance. In case of cancellation, the amounts already paid are not refundable.
In case of cancellation at the initiative of CHEMS AYOUR, a postponement of the date can always be proposed by the company. In case of impossibility to propose possible postponements, the sums paid to CHEMS AYOUR will be fully refunded to the customer.
Liability – Force majeure
CHEMS AYOUR shall not be deemed to be in breach of its obligations in the event that the performance of its obligations under the Service is hindered, prevented or delayed by a case of Force Majeure and its liability shall not, in such case, be engaged for any reason whatsoever.
Under no circumstances shall CHEMS AYOUR be held responsible or liable for any compensation or refund in the event of modification of the service, schedules or duration of the service due to Force Majeure or instructions given by the competent authorities. Considered as a case of Force Majeure within the meaning of these general terms and conditions of sale, any event, reasonably unforeseeable and insurmountable for the company CHEMS AYOUR, making impossible or significantly more expensive the execution of all or part of its contractual obligations under the Service, natural disasters, bad weather, fire, flood, earthquake, strike or any other social movement, power failure, embargo, sabotage, intervention of civil or military authorities, acts of war, declared or undeclared hostilities, terrorist acts or riots.
Internal regulations
Only persons who have reached the age of majority may enter CHEMS AYOUR to attend the show and consume alcoholic beverages on site.
Proper attire and respectful behavior towards the employees of CHEMS AYOUR and the artists is required. CHEMS AYOUR reserves the right to refuse access to or remove any Customer who disrupts the performance, without any refund or compensation.
Animals are not allowed in CHEMS AYOUR’s establishment, except for guide dogs in accordance with the regulations in force.
With regard to the timetable, the client or the whole group must arrive at the place of the service at the latest 15 minutes before the time scheduled for its beginning. If the customer arrives after the beginning of the service, he will not be able to claim any refund.
CHEMS AYOUR declines all responsibility for any damage concerning any object brought by the Customer which would not have been the object of a deposit in the premises arranged for this purpose.
It is not forbidden to photograph, film or record, all or part of the room of CHEMS AYOUR and the Show.
It is also forbidden to reproduce the texts, logos, images or any other elements appearing on the website, on the ticket, on the emails sent by the company CHEMS AYOUR or on any other document issued by the company CHEMS AYOUR
The content of this website, the shows, the sets and costumes as well as all creations made especially for/by CHEMS AYOUR are protected by copyright, trademark rights, or any other intellectual or industrial property privilege.
Consequently, all the elements appearing on the website or during the broadcasting of the show cannot be reproduced or registered.
The name “CHEMS AYOUR” is a registered trademark; its use by an unauthorized third party, except in cases provided for by law, is strictly prohibited and constitutes an act of infringement punishable by the Code of Intellectual Property
Applicable law
The services offered within the framework of this site and governed in particular, by the present conditions of sale is subjected to the Moroccan Law. In the event of litigation, the Moroccan courts are only competent.
